TICKET SALES AND ONLINE RESERVATION TERMS AND CONDITIONS

§ 1 General Provisions

These terms and conditions (hereinafter referred to as the "Terms and Conditions") define the rules for booking and purchasing tickets for the Flyport by Baltona educational and entertainment zone located in the departure terminal of Warsaw-Radom Airport, at the address: ul. Lubelska 158, 26-603 Radom (hereinafter referred to as "Flyport").

Ticket sales are conducted by Przedsiębiorstwo Handlu Zagranicznego "Baltona" S.A. based in Warsaw (02-146), at ul. Komitetu Obrony Robotników 49, entered into the register of entrepreneurs maintained by the District Court for the capital city of Warsaw, XIV Commercial Division of the National Court Register under KRS number: 51757, REGON number: 000144035, NIP number: 5860102292 (hereinafter referred to as "Baltona").

Tickets are sold via the website available at www.biletyflyport.pl (hereinafter referred to as the "Website").

Purchasing or booking tickets for Flyport via the Website is only possible after accepting the Terms and Conditions and the "Flyport by Baltona Educational and Entertainment Zone Terms and Conditions," available on the website at www.flyport.pl.

The current schedule of dates and hours for admission to Flyport is available at www.flyport.pl.

Through the Website, only individual tickets can be purchased, while for organized groups, only reservations can be made.

By purchasing a ticket via the Website, the buyer enters into a remote ticket purchase agreement with Baltona.

The buyer has no right to return the tickets, and in the case of consumers, ticket returns are not possible in connection with entering into a remote agreement, pursuant to Article 38(1)(12) of the Consumer Rights Act of May 30, 2014 (consolidated text, Journal of Laws of 2023, item 2759), unless otherwise stated in these Terms and Conditions.

§ 2 Online Group Ticket Reservation (Group Tickets)

A group is defined as an organized group consisting of ten [10] or more people.

For every ten [10] people in the group, one [1] free ticket is provided for the group leader.

Each online group ticket reservation is assigned a unique number and requires payment through a separate transaction.

When making an online ticket reservation, the visitor must select the date and time of the visit to Flyport and then enter the following information in the data form: the reserving person's first and last name, phone number, email address, full name of the institution, the appropriate type and number of tickets from the available price categories, and all necessary data for invoicing.

If the reserving person selects the "VAT Invoice - Yes" box in the reservation system, the invoice will be ready for collection on-site along with the Flyport admission tickets. The invoice can be sent electronically only upon prior telephone or email request (rezerwacje@flyport.pl).

After making the reservation referred to in paragraph 5 above, the reserving person will receive a confirmation email. Payment for the reservation must be made within ten [10] days of making the reservation to the bank account provided in the confirmation email. The date of proper payment is considered the date the funds are credited to Flyport's account. For international transfers, please note the longer procedure for transferring funds to Flyport's account. Until the payment is credited to Flyport's account, the reservation is temporary, until the deadline specified in this provision.

If payment is not made within the time specified in paragraph 6 above, the reservation will be canceled.

After the payment is made and the reservation is successfully completed, a VAT invoice is issued, and the tickets are printed. The tickets must be collected at the Flyport ticket office no later than on the day of the visit and no later than 30 minutes before the start of the tour.

The group reservation process can be initiated up to 180 days in advance and no later than five [5] days before the scheduled visit to Flyport.

§ 3 Online Ticket Purchase for Individual Visitors

When making a purchase, you must select the date of the visit to Flyport and then fill in the form with the following information: the buyer's first and last name, phone number, email address, and the type and number of tickets.

Individual tickets can be purchased up to 60 days in advance.

A family ticket grants one [1] spot for the selected date, for up to two [2] adults, in accordance with §4(1)(5) of the Terms and Conditions.

Children under the age of three are entitled to free admission to Flyport.

If the buyer has selected the "VAT Invoice - Yes" option in the reservation system, the invoice will be sent electronically.

Payment for the reservation must be made within one [1] hour of making the reservation (either directly via the Website or through the link provided in the email sent to the address provided during the purchase). Baltona enables payments through the Autopay system. Before making a payment, the buyer should verify whether the system supports the bank from which the payment will be made or use a payment card accepted by the system. To complete the payment, the buyer should follow the instructions displayed on the payment provider’s page, i.e., Autopay.

Each online individual ticket purchase transaction will be assigned a unique number. Each buyer will receive tickets electronically. By selecting the appropriate option during the ticket purchase process, it is possible to collect tickets at the Flyport ticket office based on the purchase number mentioned in the previous sentence.

If the payment is not made within the time specified in section 6, the reservation will be canceled.

The buyer is responsible for properly printing the tickets and for securing the tickets in their email inbox. It is not possible to resend the tickets.

§ 4 Ticket Types

Tickets for Flyport are divided into the following categories:

Regular ticket – for adults, i.e., individuals aged 18 and above;

Discounted ticket – available for: a) children and school students under the age of 18 (upon presentation of a school ID); b) holders of a Pole’s Card under the age of 18 (upon presentation of the Pole’s Card); c) persons under 18 with a disability (upon presentation of a disability certificate and a photo ID or a disability card; for those with a severe disability, the ticket purchase entitles them to enter with a personal assistant, who must collect a separate free ticket);

Adult discounted ticket – available for: a) school students aged between 18 and 19 (upon presentation of a school ID); b) university students and doctoral candidates up to the age of 26 (upon presentation of a student or doctoral ID); c) holders of a Pole’s Card (upon presentation of the Pole’s Card); d) retirees and pensioners (upon presentation of an ID with a photo, or in the case of an ID without a photo, both the ID and an identity document); e) seniors over the age of 65 (upon presentation of a photo ID); f) persons over 18 with a disability (upon presentation of a disability certificate and a photo ID or disability card; for those with a severe disability, the ticket purchase entitles them to enter with a personal assistant, who must collect a separate free ticket);

Group ticket – for organized groups of at least 11 people, including one [1] supervisor.

Family ticket – for two adults, i.e., persons aged 18 and above.

Admission to Flyport is free for children under the age of 3, but a free ticket must be obtained at the Flyport ticket office. This free ticket can only be collected when purchasing a ticket as specified in §4(1)(1), (3), or (5) of the Terms and Conditions (i.e., regular ticket, adult discounted ticket, or family ticket).

Each ticket type specified in this §4 of the Terms and Conditions grants admission to Flyport, in accordance with the information provided on the ticket.

The buyer is responsible for appropriately storing and securing the ticket. In the event of any discrepancy between the ticket and the order, it should be reported immediately to Baltona via email: rezerwacje@flyport.pl.

§ 5 Contact

The contact methods mentioned above are available Monday through Friday, from 8:00 AM to 4:00 PM.

§ 6 Complaints

Complaints related to ticket purchases via the Website can be submitted electronically by sending the complaint to reklamacje@flyport.pl or in writing to: Przedsiębiorstwo Handlu Zagranicznego „Baltona” S.A., ul. Komitetu Obrony Robotników 49, 02-146 Warszawa.

Baltona will respond to complaints promptly, but no later than 14 days after receiving them, in the same form in which the complaint was submitted, unless the complaint specifies a different form of response.

Submitting a complaint represents an attempt at amicable dispute resolution. Regardless of whether the complaint is accepted, the person submitting it retains the right to pursue claims in court.

Consumers may also use out-of-court methods for handling complaints and pursuing claims, particularly by seeking assistance from consumer organizations or municipal (or county) consumer advocates. Detailed information on alternative dispute resolution methods for consumers is available on the Office of Competition and Consumer Protection's website: www.uokik.gov.pl.

Consumers also have the option to use the EU’s Online Dispute Resolution (ODR) platform, available at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=PL.

§ 7 Personal Data Protection

Your personal data will be processed in accordance with applicable laws, specifically Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, on the protection of natural persons regarding the processing of personal data and the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119/1 of 05.04.2016) (hereinafter: GDPR).

The controller of your personal data processed in connection with online ticket purchases is: Przedsiębiorstwo Handlu Zagranicznego „Baltona” S.A., headquartered in Warsaw (02-146), at ul. Komitetu Obrony Robotników 49, registered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw, XIV Commercial Division of the National Court Register under KRS number 51757, REGON: 000144035, NIP: 5860102292 (hereinafter: the Controller).

For matters related to personal data protection, you can contact the Controller or their designated Data Protection Officer by traditional mail (at the address listed above) or by email at rodo@baltona.pl.

The Controller will process your personal data (name, surname, email address, phone number, payment details, and data necessary for issuing an invoice – in the case of individuals conducting business activities) for the following purposes and based on the following legal grounds: a. to take actions necessary to conclude a ticket purchase agreement via the Website – based on Article 6(1)(b) GDPR; b. to perform actions related to transaction processing for ticket purchases – based on Article 6(1)(b) GDPR; c. to handle complaints if submitted, which is the Controller’s legitimate interest – based on Article 6(1)(f) GDPR; d. to fulfill legal obligations, including tax regulations and anti-money laundering laws – based on Article 6(1)(c) GDPR; e. to assert or defend claims, which is the Controller’s legitimate interest – based on Article 6(1)(f) GDPR.

Your personal data may be shared with entities cooperating with the Controller if such sharing is necessary to complete the ticket purchase, such as IT service providers, accounting services, legal services, and payment solution providers.

Your personal data will not be transferred to third countries or international organizations.

Your personal data will be stored for the duration necessary to fulfill the contract and legal obligations (generally for 5 years). In cases of claims or legal defense, the data will be stored until the expiration of the claim period or the conclusion of legal proceedings.

You have the right to request access to, correction of, deletion of, or restriction of processing of your personal data from the Controller, as well as the right to object, in cases specified in the GDPR.

If you believe your data is being processed unlawfully, you have the right to file a complaint with the President of the Personal Data Protection Office (address: ul. Stawki 2, 00-193 Warsaw; email: kancelaria@uodo.gov.pl).

Providing personal data is voluntary but necessary to conclude a ticket purchase agreement. Refusing to provide personal data will prevent you from purchasing a ticket via the Website.

Your personal data will not be subject to automated decision-making or profiling.

§ 8 Final Provisions

Flyport reserves the right to modify an existing reservation in justified cases. In such cases, individuals who made prior reservations are entitled to either reschedule or receive a refund for their tickets.

Invoices for entry to Flyport are issued within seven [7] days of the ticket purchase date.

Invoices are issued based on receipts.

Flyport reserves the right to amend this Regulation. The amended regulation will be made publicly available on the website www.flyport.pl and at Flyport ticket offices. In the event of changes to the Regulation, the changes will come into effect 14 days after the new version is published. Changes to the Regulation do not affect tickets purchased before the changes, meaning that the version of the Regulation in force at the time of purchase will apply to previously purchased tickets.

Ticket reservations are subject to the prices listed in the current price list.

This Regulation does not infringe upon the provisions of the “Flyport by Baltona Educational and Entertainment Zone Regulations,” which are available on the website www.flyport.pl and at Flyport ticket offices.

In matters not covered by this Regulation, the provisions of the “Flyport by Baltona Educational and Entertainment Zone Regulations” apply accordingly.

The laws of the Republic of Poland apply to this Regulation.

This Regulation is effective as of September 5, 2024.
